DMCA / Copyright Policy

Boothio respects the intellectual property rights of others and expects users of the Service to do the same. This page describes how copyright owners can submit notices of claimed infringement and how users can submit counter-notices, in line with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and the EU Digital Services Act (DSA), Article 16.

1. Designated Agent

2. Filing a Copyright Notice

To file a notice of claimed infringement, send a written communication to the email above containing all of the following (per 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
  3. Identification of the material claimed to be infringing, including a URL or other information sufficient to allow Boothio to locate the material.
  4. Your contact information (name, address, telephone number, email).
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the owner of the exclusive right.

Notices missing any of these elements may not be valid and may delay our response.

3. Our Response

Upon receipt of a valid notice, Boothio will:

  • Acknowledge receipt within 24–72 hours
  • Investigate the claim and remove or disable access to the material if appropriate
  • Notify the user who uploaded the content and forward the notice details (with personal information of the complainant redacted where required)
  • Apply a copyright strike to the uploader's account

4. Counter-Notice Procedure

If you believe content of yours was removed in error, you may submit a counter-notice under 17 U.S.C. § 512(g). Email hello@boothio.ai with all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or, if your address is outside the United States, for any judicial district in which Boothio may be found, and that you will accept service of process from the person who provided the original notice.

If we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant files a lawsuit within 10–14 business days, we may restore the removed content.

5. Repeat Infringer Policy

Boothio maintains a policy of terminating accounts of users who are determined to be repeat infringers. Three (3) substantiated copyright infringement claims, validated through this DMCA notice process, will result in permanent termination of your account without refund.

6. False Claims

Knowingly making a material misrepresentation in a DMCA notice or counter-notice may expose you to liability for damages under 17 U.S.C. § 512(f), including costs and attorneys' fees. Please ensure your notice is accurate and made in good faith.

7. Non-U.S. Users (EU DSA Article 16)

Users outside the United States may use the same email above to submit notices of allegedly illegal content under EU Digital Services Act Article 16. Notices should include the same information as required for DMCA notices, plus an explanation of why the content is considered illegal under the relevant local law.
